Waste Collection Notting Hill Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Notting Hill provides waste collection and related services to customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, unless the context requires otherwise, the following expressions have the following meanings:

Customer means any individual, business, organisation or other entity that books or uses our waste collection services.

Services means any waste collection, removal, clearance, loading, transportation, or related services provided by us.

Waste means any items, materials, rubbish or refuse presented by the Customer for collection, including household waste, commercial waste, bulky items and other non-hazardous materials, except where specifically excluded under these Terms and Conditions or applicable legislation.

Booking means a confirmed request for Services made by the Customer and accepted by us in accordance with these Terms and Conditions.

We, us and our mean the waste collection service provider trading as Waste Collection Notting Hill.

2. Scope of Services

We provide local waste collection services, including but not limited to household waste clearance, commercial waste removal, bulky item collection and general rubbish removal. The specific Services to be provided will be as described in the booking confirmation and may vary depending on the type, volume and nature of waste to be collected.

We reserve the right to refuse to collect any waste that we reasonably believe to be hazardous, unlawful, contaminated, prohibited, or otherwise unsuitable for collection or transport under UK legislation or industry best practice.

3. Booking Process

3.1 Bookings may be made by telephone, email or through our online enquiry channels, where available. All bookings are subject to acceptance by us and to these Terms and Conditions.

3.2 To place a booking, the Customer must provide accurate and complete information including but not limited to:

a) Full name and contact details.

b) Collection address and, if applicable, access instructions.

c) Description, quantity and approximate weight or volume of the waste.

d) Preferred date and time window for collection.

e) Any relevant information about parking, loading restrictions or access limitations.

3.3 We will provide the Customer with an estimated price based on the information supplied. The final price may be adjusted if, on arrival, the waste is materially different in type, volume or access difficulty from that originally described by the Customer.

3.4 A Booking will be considered confirmed only once we have issued a booking confirmation by email, text or verbal confirmation and, where applicable, once any required deposit or prepayment has been received.

3.5 The Customer is responsible for checking the booking confirmation and notifying us promptly of any errors or omissions.

4. Service Access and Customer Obligations

4.1 The Customer must ensure that our team has safe, clear and reasonable access to the collection point at the agreed time. This includes arranging any necessary permissions, parking, building access, gate codes or keys.

4.2 Waste must be ready for collection at the agreed time and must be presented in a safe and secure manner. Loose, scattered or hazardous items should be safely contained where possible.

4.3 The Customer warrants that they either own the waste being collected or have full authority from the owner to arrange its removal and disposal.

4.4 The Customer must not present any prohibited waste, including but not limited to asbestos, clinical or medical waste, flammable liquids, explosives, gas cylinders, chemicals, oils, paint cans with liquid contents, or any substance classified as hazardous under applicable law unless such collection has been expressly agreed in writing in advance and is within our licensed capabilities.

5. Prices and Payment Terms

5.1 Prices for our Services are based on factors including but not limited to volume, weight, type of waste, labour time and access conditions. Any prices provided prior to collection are estimates only and may be adjusted once the waste has been assessed on site.

5.2 Unless otherwise agreed, payment is due in full on completion of the collection, and before our team leaves the site. We may accept cash, debit or credit card or other payment methods notified to the Customer at the time of booking.

5.3 For business Customers, and only where agreed in advance, we may issue an invoice with specified payment terms. Time for payment shall be of the essence. If payment is not received by the due date, we reserve the right to charge interest on overdue sums at the statutory rate allowed under applicable law and to recover all reasonable costs of collection.

5.4 All quoted prices are exclusive of VAT unless otherwise stated. Where VAT is chargeable, the applicable rate will be added to the invoice.

5.5 We reserve the right to revise our prices at any time. Any change in prices will not affect a confirmed booking already accepted by us, except where the waste volume, type or access conditions differ from the information originally provided by the Customer.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by giving us as much notice as reasonably possible. Cancellations or amendments must be communicated by telephone or email.

6.2 If the Customer cancels a booking more than 24 hours before the scheduled collection time, any deposit paid may be refunded at our discretion, minus any reasonable administrative costs.

6.3 If the Customer cancels a booking within 24 hours of the scheduled collection time, or fails to provide access to the collection point at the agreed time, we reserve the right to charge a cancellation fee. This may include any call-out charges, travel time, waiting time and labour already incurred.

6.4 If, on arrival, we are unable to carry out the collection due to safety concerns, access restrictions or the presentation of prohibited or significantly different waste, we may treat the booking as cancelled by the Customer and apply the relevant cancellation or call-out charges.

6.5 We will use reasonable efforts to attend on the agreed date and time, but such timings are estimates only. We shall not be liable for any loss or inconvenience arising from delays or the need to reschedule due to traffic, weather, vehicle breakdown, staff illness, or other events beyond our reasonable control.

7. Performance of Services

7.1 Our team will carry out the collection with reasonable skill and care in accordance with industry standards and applicable legislation.

7.2 Unless otherwise agreed in writing, our Services include loading the waste into our vehicle from an accessible area on the Customer's premises or agreed collection point.

7.3 Our team may, at their discretion, assist with moving items from inside the premises to the collection vehicle. This is subject to safe working conditions and is not guaranteed. The Customer is responsible for ensuring that any such assistance can be provided safely and without risk of damage to property.

7.4 Once the waste has been loaded into our vehicle and the Customer has made payment, title to the waste passes to us and we will take responsibility for its transport, treatment and disposal in accordance with applicable waste regulations.

8. Compliance with Waste Regulations

8.1 We will handle, transport and dispose of collected waste in accordance with applicable UK waste management legislation and guidance, including the duty of care relating to the proper handling of controlled waste.

8.2 Where required, we will hold any necessary licences, registrations or permits for the collection and transport of waste and will use lawful disposal or recovery facilities.

8.3 The Customer agrees to provide accurate information about the nature and origin of the waste and acknowledges that providing false or misleading information may constitute a breach of law and of these Terms and Conditions.

8.4 The Customer acknowledges their own obligations under applicable waste regulations, including the duty of care, and agrees to cooperate with us in meeting any legal requirements such as the completion of waste transfer notes or other documentation when requested.

9. Customer Warranties

9.1 The Customer warrants that:

a) They are legally entitled to arrange for the waste to be removed.

b) The waste does not contain any prohibited or hazardous materials which we have not agreed in writing to collect.

c) The information provided for the purpose of quoting, booking and documentation is complete and accurate.

9.2 The Customer shall indemnify us against all claims, losses, damages, costs and expenses arising from any breach of these warranties or from any unlawful or improper presentation of waste for collection.

10. Liability

10.1 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited under applicable law.

10.2 Subject to clause 10.1, we shall not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, loss of opportunity or loss of goodwill, arising out of or in connection with the provision or non-provision of the Services.

10.3 Subject to clause 10.1, our total aggregate liability to the Customer in respect of any claim arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the total fees actually paid by the Customer for the specific booking giving rise to the claim.

10.4 The Customer is responsible for ensuring that any fragile, high-value or delicate items are removed from the collection area prior to our arrival. We shall not be liable for damage to such items unless caused by our wilful misconduct or gross negligence.

10.5 We shall not be responsible for any damage to driveways, paths, access routes, surfaces or underground services caused by the weight or movement of our vehicles, where the Customer has requested or permitted us to enter their property.

11. Personal Data and Privacy

11.1 We will process any personal data provided by the Customer in the course of providing the Services in accordance with applicable data protection legislation.

11.2 Personal data may be used for the purposes of administering bookings, providing the Services, handling payments, managing accounts and, where permitted, for reasonable service-related communications.

12. Force Majeure

12.1 We shall not be in breach of these Terms and Conditions or otherwise liable for any failure or delay in performing our obligations where such failure or delay results from events, circumstances or causes beyond our reasonable control. These may include, but are not limited to, extreme weather, traffic disruption, accidents, strikes, pandemics, utility failures or acts of government.

13. Changes to Terms and Conditions

13.1 We reserve the right to update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise communicated to the Customer, and will apply to all bookings made thereafter.

13.2 The version of the Terms and Conditions in force at the time of booking will apply to that booking unless otherwise agreed in writing.

14. Severability

14.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, such provision shall be severed from the remaining provisions which will continue to be valid and enforceable.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services provided, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
